ObamaCare Facts: I am under age of 26, can I claim myself as a dependent and still be under my parent's plan?

I had a (young) friend ask me about this so I pass it on to my readers:
Do my parents have to claim me as a dependent on their taxes 
for me to stay on their insurance plan?
FACTS ABOUT
Health coverage for adults
(ObamaCare refers to them “children”) under 26:

The Affordable Care Act requires insurance companies to cover young adults on their parent’s plan until age 26 if the plan offers dependent coverage, regardless of your tax status, student status, state of residence, or marital status. In other words, you do not need to be a tax dependent of your parents to continue to be covered as a dependent on their health plan.

If a plan covers children, they generally can be added to or kept on a parent's health insurance policy until they turn 26 years old.
Children can join or remain on a parent's plan even if they are:
  • ·         Married
  • ·         Not living with their parents
  • ·         Attending school
  • ·         Not claimed as a dependent on their parent’s tax return
  • ·         Eligible to enroll in their employer’s plan

These rules apply to both job-based plans and individual plans bought inside or outside the Marketplace.
Note: Some states and plans use different maximum coverage ages. Check with your plan to find out how long an adult child can stay on your plan.

After you are safely enrolled in Obama Care (so you won’t have to pay the penalty) we can then get all those other exposures taken care of for you (like helping you to be able to pay those Obamacare high deductibles, etc.). I will even help people to re-enroll this year; doing this on your own can create problems as some of my clients found out last year. Again, I don’t charge for this service and I work with you by having you share my computer screen so you can do this without leaving your home.
